These Terms of Service ("Terms") govern your use of industrialgrademarketing.com (the "Site") and the internal Google Ads API application operated by Industrial Grade Marketing, LLC ("Industrial Grade Marketing," "we," "us," or "our") (the "Application"). By using the Site or authorizing the Application you agree to these Terms. Paid services are governed by a separate written services agreement; if there is a conflict, the services agreement controls.
You may use the Site for lawful purposes to learn about our services and contact us. You may not attempt to interfere with the Site, scrape it in bulk, or use it to send spam or unlawful content.
Advertising performance depends on factors outside our control, including auction competition, Google policy, your website, and your sales process. We do not guarantee any specific number of leads, clicks, rankings, conversions, or revenue.
Use of the Site is free. Fees for our services are set out in your services agreement. Advertising spend is billed to you directly by Google unless otherwise agreed in writing.
The Site, our logo, and our content are owned by Industrial Grade Marketing, LLC or its licensors. Campaign assets created for a client are governed by the services agreement. "Google" and "Google Ads" are trademarks of Google LLC; we are an independent agency and are not affiliated with or endorsed by Google.
The Site and Application are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, Industrial Grade Marketing, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from your use of the Site or Application. Our total liability for any claim related to the Site or Application will not exceed one hundred U.S. dollars ($100) or, for paid services, the amount stated in the applicable services agreement.
You agree to indemnify and hold harmless Industrial Grade Marketing, LLC from claims arising from your violation of these Terms, your Google Ads account, or content and landing pages you supply.
We may suspend or end access to the Application if you violate these Terms or Google policies, or if required by Google. You may stop using the Site or unlink your Google Ads account at any time.
These Terms are governed by the laws of the State of Indiana and applicable United States federal law, without regard to conflict-of-law rules. Disputes will be resolved exclusively in the state or federal courts located in Indiana, and you consent to their jurisdiction.
We may update these Terms. Continued use of the Site or Application after changes are posted constitutes acceptance.
